These Terms of Service ("Terms") govern your access to and use of ReviewMatic ("Service"), operated by ReviewMatic ("we," "us," or "our"). By signing up for or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
ReviewMatic is a subscription software service that connects to your Google Business Profile(s) to automatically generate and post AI-written replies to your Google reviews, and to send automated review request campaigns to your customers via email and SMS. You retain full responsibility for the content posted to your Google Business Profile(s) through the Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use ReviewMatic. By using the Service, you represent that you meet these requirements. The Service is intended for use by US-based businesses. Use from outside the United States is at your own risk and may not comply with local laws.
3. Account Registration
You must create an account to use ReviewMatic. You agree to provide accurate, complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. Subscriptions and Payment
ReviewMatic is offered on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. Prices are as listed on our pricing page and may change with 30 days' notice to existing subscribers.
All subscriptions include a free trial period as advertised at signup. After the trial, you will be charged unless you cancel before the trial ends. No refunds are issued for partial billing periods.
Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms of service.
5. Cancellation
You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period. You will retain access to the Service through the end of the period you have paid for. We do not pro-rate refunds for unused time.
6. Acceptable Use
You agree not to use ReviewMatic to:
- Post false, misleading, or defamatory content to Google or any other platform
- Harass, spam, or contact individuals without their consent
- Violate Google's Terms of Service or policies for Google Business Profile
- Violate the CAN-SPAM Act, TCPA, or any other applicable law governing electronic communications
- Upload contact lists you do not have the right to use
- Reverse engineer, copy, or create derivative works from the Service
- Use the Service for any unlawful purpose
We reserve the right to suspend or terminate your account for violations of these terms, without refund.
7. Google Terms Compliance
ReviewMatic accesses your Google Business Profile via the Google My Business API under your authorization. You are solely responsible for ensuring your use of the Service complies with Google's Terms of Service and review policies. We are not affiliated with Google LLC.
8. AI-Generated Content
ReviewMatic uses artificial intelligence to generate review reply suggestions and campaign messages. You acknowledge that AI-generated content may occasionally be inaccurate, inappropriate, or unsuitable for your business. You are responsible for the content posted to your Google Business Profile. We recommend periodically reviewing the replies the Service posts on your behalf.
9. Data and Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.
10. Intellectual Property
ReviewMatic and its original content, features, and functionality are owned by us and protected by intellectual property laws. You retain ownership of your business data, customer data, and any content you provide. You grant us a limited license to use your data solely to provide and improve the Service.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVIEWMATIC'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
13. Indemnification
You agree to indemnify and hold harmless ReviewMatic and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party rights.
14. Governing Law
These Terms are governed by the laws of the United States and the state of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or in-dashboard notice. Continued use of the Service after changes are effective constitutes your acceptance of the updated Terms.
